 PART 3 - WARRANTS OF APPOINTMENT

 

1.      Warrants are issued by SHQ, to Leaders of the following ranks:

 

A). State Commissioners.

 

B). Training Commissioner, Quartermaster, Badge Secretary, State Secretary.

 

C). District Commissioners.

 

D). District Scouters.

 

2.      Warrants are not issued for:

 

A). Honorary rank conferred by the State Council.

 

B). Instructors.

 

C). Badge Examiners.

 

D). Chaplains.

 

3. Warrants of Appointment are also issued by the State Council for all District and Group Leaders under their jurisdictions.

 

4. A person may not hold two or more Warrants of Appointment, unless he or she has the time and ability to carry out the duties involved.  In every case, it is subject to the approval of the SC and the appropriate council.

 

5. Warrants of Appointment are valid until revoked or surrendered or for such period as stipulated on issue - but in every case they cease to be effective on the holder discontinuing, or failing to perform, the duties for which they were issued.

 

6. Warrants for the role of SC are dealt with by SHQ, and no application is necessary.

 

7. Applications for Warrants of Appointment for other roles of commissioners are made to the State Council in the normal way by the SC who will in all cases observe the precautions laid down in articles 16 and 17.

 

8. Applications for Warrants of Appointment are made by the DC in accordance with the procedure set out in Articles 9 to 20 inclusive.

 

9.  A member of the District Council must nominate Leaders for Warrants of Appointment as District Leaders, as Group Leaders or as GSM, to the DC.  The person nominated must have fulfilled all membership requirements of this Association.

 

10. In the case of applications for Leaders of Sponsored groups, the nomination must be made known and approved by the Sponsoring Authority.

 

11. The DC must immediately inform the SC of any application.

 

12. Applicants for Warrants of Appointment must serve a probationary period of 4 months in the actual role for which the Warrant of Appointment is requested.  During the probationary period, the DC (or delegate) will satisfy himself that the applicant is competent, and has completed a WB1 course.

 

13. The DC must be satisfied in every case that the applicant is fully fitted by character and previous history to be trusted with the care of youth members, and has, in particular:

 

A). the necessary qualifications required by the rule relating to the role in question.

 

B). a full appreciation of the religious and moral aim underlying the scheme of this Association.

 

C). personal standing and character such as will ensure a good moral influence and sufficient steadfastness of purpose to carry out the work with energy and perseverance.

 

D). a willingness to avail themselves of any facilities offered for training appropriate to their role.

 

14. In the case of a Group Leader, other than the GSM, the DC must ascertain that the GSM approves the recommendation for a Warrant of Appointment.

 

15. The DC must in every case, satisfy himself independently of the District Council, that the applicant is qualified and suitable as in Articles 10 to 12 inclusive, and that the foregoing procedure is strictly and properly observed.

 

14.  In view of the responsibility to parents, and of the dangers which have been found to exist, District Commissioners and District Councils must take every precaution to ensure that no one whose moral character is open in any way to suspicion be admitted into this Association.  They must show no mercy in any case where such a person has gained admission.  Where circumstances indicate that a criminal offence may have been committed, DC must see that the Police and the SC are informed immediately.

 

17. Where any person whose character and past history are not fully known makes an offer of service, or seeks to be associated in any way with this Association, the matter must be immediately reported to the DC, who will at once consult State Council in confidence.

 

18. Reference Article 17, in the absence of a DC, the Leader in charge of the Group concerned must communicate directly with the SC.

 

19. Reference Article 17, when the State Council is satisfied, application for membership to this Association will be forwarded to the person making the offer of service or seeking to be associated with this Association.

 

20. Reference Article 17, where recommendation is refused at the District level, a report by the District Council must immediately be sent to the SC.

 

CANCELATION

 

21. Warrants of Appointment are cancelled with just cause, by SHQ at its discretion, as follows:

 

A). SC  -- at the sole discretion of the State Council.

 

B). Other Commissioners -- after inquiry, on the recommendation of the SC.

 

C). District or Group Leader -- on the recommendation of the DC and the respective Council; following an inquiry by the DC and if applicable, the District council, at which the Leader concerned is entitled to be heard.

 

D). All roles -- on the Warrant of Appointment ceasing to be effective under Article 4 or 5, or by resolution of the State Council.

 

22. In the case of a Sponsored Group, the Sponsoring Authority is entitled to be heard by the DC, and, if necessary, District Council in any matter concerning the cancellation of a Warrant of Appointment of any Leader of the Group.

 

23. Reference Article 22, where the Sponsoring Authority is a Church and it expresses itself dissatisfied with a Leader of the Group, the District Council shall give its views provided the objection is based solely on the premise that the Leader is not fulfilling religious duties either by example or precept.  Where, however, any other question, such as moral character or technical efficiency is involved, the matter must be dealt with in accordance with Articles 21 (C) and 36.

 

SUSPENSION

 

24. Where it appears desirable in the interests of this Association, the holder of a Warrant of Appointment may be suspended as follows:

 

A). SC  -- by State Council

 

B). Other Commissioners -- by the SC

 

C). District or Group Leader -- by the DC or SC.

 

 

25. A person thus suspended must, for the time being,

 

            A). surrender their Warrant of Appointment in accordance with Article 34,

 

            B). refrain from participation in any activity connected with this Association, and

 

            C). must not wear uniform or badges. 

 

Any role or appointment held in this Association by such a person is to be considered vacant for the time being.  Any case of difficulty arising under this rule should be referred to the State Council.

 

26. A SC, who has suspended any Commissioner, must immediately report the case with full details to SHQ & HQ.

 

27. A DC who has suspended any Leader, must immediately report the case with full details to the SC.

 

28. Suspension by the DC is a purely temporary measure.  The DC and District Council must follow it as soon as possible with a full inquiry.  For this purpose, the DC will ask for SC assistance.

 

29. Reference Article 28, the person suspended must be informed of the inquiry and be given reasonable opportunity to attend and state their case.  This must occur within 30 days of the date of suspension.

 

30. Reference Article 28, if a Sponsored Group is affected, the Sponsoring Authority must be given similar opportunity to attend and be heard at the inquiry.

 

31. Reference Article 28, a suitable person should be appointed as Chairman of the inquiry.  Such chairman may not be the DC, but must be a person having membership within this Association, but not necessarily with the District Council concerned.  Where no agreement can be reached on the Chairman, the State Council will appoint a Chairman.

 

32. Reference Article 28, at the conclusion of the inquiry either (a) the suspension must be withdrawn or (b) a probationary period with corrective guidelines instituted or (c) a recommendation for cancellation of the Warrant of Appointment made to the SC.  The Chairman must forward a full report to the SC

 

 

 

RETURN OF WARRANTS

 

33. Warrants of Appointment remain the property of SHQ and must be returned to SHQ at any time on demand for due cause.

 

34. Warrants of Appointment must be returned on demand, as follows:

 

A). SC  - direct to State Council.

 

B). Other Commissioners - direct to SC

 

C). District or Group Leaders - direct to SC

 

And also in any of the following circumstances:

 

A). On the Warrant of Appointment ceasing to be effective under Articles 5

 

B). Where the recommendation for cancellation is made to a SC under Article 32

 

35. A DC, when returning a Warrant of Appointment of any District or Group Leader must attach a report.  Where the circumstances are such that the person concerned has failed to render satisfactory service, or is in any way undesirable as a member of this Association or unfit to have charge of youth members; a report must be sent to HQ through the SC.

 

36. If in any question relating to a Warrant of Appointment, the District Council and the DC are unable to agree, the matter must be referred to the SC.  The SC will appoint if possible, another DC to mediate the matter.  The mediator will report the decision to the SC.

 

TRANSFERS

 

37. Where a Leader changes roles in the same Group, or takes up work with another Group or in another Council, the case must be treated as per Article 5 and the former Warrant of Appointment, must be returned.  An application for the issue of a new Warrant of Appointment for the new position must be made.

 

38. Reference Article 37, it is most important that the service history and new address of any Leader leaving a District be passed to the State Secretary.  This will facilitate the information being forwarded to the DC of the new location.
